TO

Establish the BBC Licence Fee Commission to make recommendations to the Secretary of State on the settlement for BBC funding from 1 April 2022, after conducting public and Parliamentary consultation.

Be it enacted by the Queen’s most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:—

1 BBC Licence Fee Commission

(1) The Secretary of State must, by regulations made by statutory instrument, set up an independent body (“the BBC Licence Fee Commission”).

(2) It is to be the duty of the BBC Licence Fee Commission to make a recommendation to the Secretary of State regarding the level of licence fee and licence fee revenue required to fund the BBC for the purposes set out in the Royal Charter and Agreement in respect of the settlement from 1 April 2022, and for each successive settlement thereafter.

(3) Before making the recommendation to the Secretary of State outlined in subsection (2), the BBC Licence Fee Commission must conduct a full public consultation on appropriate levels of BBC funding and lay a report of the findings of the consultation before each House of Parliament.

(4) A statutory instrument containing regulations under this section may not be made unless a draft of the instrument has been laid before, and approved by a resolution of, each House of Parliament.

2 Duty of the Secretary of State in determining funding settlement

In determining the settlement for BBC funding for the period from 1 April 2022 and each successive settlement thereafter, the Secretary of State must consider whether or not to accept the BBC Licence Fee Commission’s recommendation and, if the Secretary of State decides to reject that recommendation, the Secretary of State must publish the reasons for the rejection.


3 Extent, commencement and short title

(1) This Act extends to the whole of the United Kingdom.

(2) This Act comes into force at the end of the period of two months beginning with the day on which this Act is passed.

(3) This Act may be cited as the BBC Licence Fee Act 2017.
