Parking Places (Variation of Charges) Bill

A Bill to make provision in relation to the procedure to be followed by local authorities when varying the charges to be paid in connection with the use of certain parking places.

Make provision in relation to the procedure to be followed by local authorities when varying the charges to be paid in connection with the use of certain parking places.

Be it enacted by the Queen’s most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:—

1 Procedure for varying charges at off-street parking places

(1) Section 35C of the Road Traffic Regulation Act 1984 (variation of charges at off-street parking places) is amended as follows.

(2) In subsection (4), after paragraph (a) insert—

(aa) consultation about their proposal;”.

(3) After subsection (4) insert—

(4A) Regulations under this section may make different provision for different purposes.”

2 Procedure for varying charges at designated parking places

(1) Section 46A of the Road Traffic Regulation Act 1984 (variation of charges at designated parking places) is amended as follows.

(2) In subsection (4), after paragraph (a) insert—

(aa) consultation about their proposal;”.

(3) After subsection (4) insert—

(4A) Regulations under this section may make different provision for different purposes.”

3 Commencement, extent, application and short title

(1) This Act comes into force at the end of the period of 2 months beginning with the day on which this Act is passed.

(2) This Act extends to England and Wales.

(3) But the amendments made by sections 1 and 2 apply only in relation to regulations made by the Secretary of State.

(4) This Act may be cited as the Parking Places (Variation of Charges) Act 2017.
