Amend section 33 of the Harbours, Docks and Piers Clauses Act 1847 to allow local authorities to proscribe, in certain circumstances, the transport of live animals for slaughter abroad via facilities that local authorities control and operate; and for connected purposes.

Be it enacted by the Queen’s most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:—

1 Shipping live animals via harbours, docks and piers: regulation

(1) The Harbours, Docks and Piers Clauses Act 1847 is amended as follows.

(2) At the end of section 33 insert—

“Save as provided for in section 33A.”

(3) After section 33 insert—

33A Shipping and unshipping of live animals via local authority facilities

(1) This section applies to harbours, docks and piers controlled or operated by local authorities.

(2) In section 33, the term “goods” shall not be interpreted to include live animals (save as provided for in subsection (5)).

(3) For the purposes of section 33 and this section, in the case of facilities controlled or operated by a local authority, the local authority may impose such—

(a) restrictions,

(b) requirements, and

(c) fees and charges

on the shipping and unshipping of live animals as the local authority deems appropriate and reasonable.

(4) The restrictions, requirements, and fees and charges may—

(a) make different provision for different species, type and age of animal,

(b) require animals for shipping to be fattened for a specified period after they are unshipped, and

(c) include a ban on the shipping and unshipping.

(5) For the purposes of this section, “live animals” does not include domestic pets.”

2 Extent, commencement and short title

(1) This Act extends to England and Wales only.

(2) This Act comes into force on the day after the day on which it receives Royal Assent.

(3) This Act may be cited as Harbours, Docks and Piers Clauses Act 1847 (Amendment) Act 2017.
