Careers Guidance (Access to Schools) Bill

A Bill to require schools in England to provide access to their premises and pupils to representatives from post-16 education establishments and others providing guidance on careers, training and courses; and for connected purposes.

Require schools in England to provide access to their premises and pupils to representatives from post-16 education establishments and others providing guidance on careers, training and courses; and for connected purposes.

Be it enacted by the Queen’s most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:—

1 Amendment to section 42A of the Education Act 1997

(1) Section 42A of the Education Act 1997 (Provision of careers guidance in schools in England) is amended as follows.

(2) After subsection (1) insert―

(1A) In exercising the duty in subsection (1) a responsible authority must provide access to its premises and to its pupils by providers of—

(a) 16 to 18 education or training, which includes providers of further education but not of higher education; and

(b) careers guidance.

(1B) The access in subsection (1A) is to be provided—

(a) on request by the provider; and

(b) at no charge.”

(3) In subsection (7), insert at the appropriate place―

  • ““further education” has the meaning given by section 2(3) to (5) of the Education Act 1996”;

  • ““higher education” has the same meaning as in the Education Reform Act 1988”.

2 Amendment to Academies Act 2010

(NONE) After section 1 of the Academies Act 2010 (Academy arrangements) insert the

following new section.

1ZA Duty to ensure access for providers of guidance on careers, training and courses

(1) It shall be the duty of any person with whom the Secretary of State has entered into academy arrangements, including those running institutions meeting the requirements of sections 1A (Academy schools) or 1C (Alternative provision Academies), to undertake to provide and ensure access to Academy premises and Academy pupils by providers of—

(a) 16 to 18 education or training, which includes providers of further education but not of higher education; and

(b) careers guidance.

(2) The access in subsection (1) is to be provided—

(a) on request by the provider; and

(b) at no charge.

(3) In subsection (1) “further education” and “higher education” have the same meaning as in section 42A of the Education Act 1997.”

3 Short title, commencement and extent

(1) This Act shall be cited as the Careers Guidance (Access to Schools) Act 2017.

(2) This Act shall come into force on 1 September 2017.

(3) This Act extends to England and Wales.
