Animal Fighting (Sentencing) Bill

TO

Amend the Animal Welfare Act 2006 to increase the sentence available to the court for those convicted of a criminal offence related to animal fighting; and for connected purposes.

Be it enacted by the Queen’s most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:—

1 Amendment of section 32 of the Animal Welfare Act 2006

(1) Section 32 of the Animal Welfare Act 2006 (Imprisonment or fine) is amended as follows.

(2) In subsection (1) for “7 and 8” substitute “and 7”.

(3) After subsection (1) insert—

(1A) A person guilty of an offence under section 8 shall be liable―

(a) on summary conviction, to imprisonment for a term not exceeding 6 months, or to a fine not exceeding level 5 on the standard scale, or both; and

(b) on conviction on indictment, to imprisonment for a term not exceeding 2 years, or to a fine, or both.”

2 Extent, commencement and citation

(1) This Act extends to England and Wales only.

(2) This Act comes into force at the end of a period of 6 months beginning with the day on which this Act is passed.

(3) This Act may be cited as the Animal Fighting (Sentencing) Act 2017.
